These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Indomitus ("we," "us," or "our"). By accessing or using any of our services — including our coaching programs, website, social media content on Instagram, TikTok, Threads, and YouTube — you confirm that:
You are at least 18 years of age
You have the legal capacity to enter into this agreement
You have read, understood, and agree to these Terms in full
2. Services Provided
Indomitus provides faith-integrated fitness coaching services designed to help individuals build muscle, pursue physical transformation, and grow in their Christian faith simultaneously. Our services may include:
Personalized workout programming and progressive training plans
Nutrition and dietary guidance (not medical nutrition therapy)
Faith-based devotionals, accountability, and spiritual encouragement
Educational content via social media (Instagram, TikTok, Threads, YouTube)
1-on-1 or group coaching sessions (online or remote)
The scope and delivery of services will be outlined in any separate coaching agreement or enrollment confirmation provided to you at the time of purchase.
3. Health & Medical Disclaimer
Indomitus is not a licensed medical provider, physician, registered dietitian, or mental health professional. All content, coaching, and programming provided is for general fitness and wellness informational purposes only.
Consult a qualified physician or healthcare provider before beginning any new fitness or nutrition program
If you experience pain, dizziness, shortness of breath, or any concerning symptoms during exercise, stop immediately and seek medical attention
You are solely responsible for your health decisions and physical safety during training
Indomitus assumes no responsibility for injuries, health conditions, or adverse outcomes arising from the use of our programs or content
By participating in our coaching programs, you voluntarily assume all risks associated with physical exercise and training, and release Indomitus from any and all liability for injury or harm.
4. Faith-Based Content
Indomitus is built on a foundation of Christian faith. Our coaching integrates scripture, prayer, and biblical principles as part of the transformation journey. By engaging with our services, you acknowledge that:
Faith-based content is a core part of the Indomitus experience, not optional supplementary material
Our approach reflects a Christian worldview and biblical values
Participation is voluntary — we welcome individuals from any background, but our methodology is distinctly faith-centered
We respect all individuals and do not discriminate. However, clients who are uncomfortable with faith-integrated coaching may not be the right fit for our programs.
5. Payments & Refunds
Payments. All coaching fees must be paid in full (or per the agreed installment plan) before services commence. Payments are processed securely through third-party payment processors. Indomitus does not store your payment card information.
Refunds. Due to the personalized nature of our coaching services:
Refunds are available within 7 days of purchase if no coaching sessions, programs, or materials have been delivered
Once a program has been delivered or a coaching session has occurred, all sales are final
In exceptional circumstances, refund requests may be considered at our sole discretion
Cancellations. For ongoing monthly programs, you may cancel at any time with written notice. Cancellation takes effect at the end of the current billing cycle. No prorated refunds are issued for partial months.
6. Content & Intellectual Property
All content created and published by Indomitus — including but not limited to workout programs, nutrition guides, social media posts, videos, graphics, and written materials — is the exclusive intellectual property of Indomitus.
You may not reproduce, redistribute, sell, or repurpose our content without express written permission
Sharing our free social media content for personal, non-commercial use with proper attribution is permitted
Programs and materials provided as part of a paid coaching engagement are for your personal use only and may not be shared, resold, or distributed
Any content you share with us (such as progress photos, testimonials, or feedback) may be used by Indomitus for marketing and educational purposes. We will always seek your permission before publicly identifying you.
7. User Conduct & Community Standards
Indomitus fosters a community of encouragement, accountability, and faith. All clients and followers are expected to engage with respect and integrity. The following are not permitted:
Harassment, bullying, or disrespectful conduct toward Indomitus staff or other community members
Sharing false information about your health status that could affect program design
Using our platforms to promote competing services, unsolicited sales, or spam
Any conduct that violates applicable laws or the spirit of our Christian community values
Violations may result in immediate removal from programs and community platforms without refund.
8. Limitation of Liability
To the fullest extent permitted by law, Indomitus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Physical injury or health complications arising from exercise or nutrition advice
Loss of data, revenue, or opportunities
Failure to achieve specific fitness results
Interruption of services due to circumstances beyond our control
Our total liability to you for any claim arising from your use of our services shall not exceed the amount you paid to Indomitus in the 90 days preceding the claim.
Results from fitness coaching vary based on individual effort, consistency, genetics, lifestyle factors, and adherence to programming. No specific fitness or body composition results are guaranteed.
9. Termination
Indomitus reserves the right to terminate or suspend your access to our services at any time, with or without notice, for conduct that:
Violates these Terms and Conditions
Is harmful to Indomitus, its staff, or its community
Involves fraudulent, abusive, or illegal activity
You may terminate your engagement with Indomitus at any time in accordance with the cancellation policy outlined in Section V.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration in New York County, New York.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. When changes are made, we will update the effective date at the top of this document. Continued use of our services following any update constitutes your acceptance of the revised Terms.
